Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of TariffBench (the “Service”), operated by Futurist IP (“Futurist IP,” “we,” “us,” or “our”), a corporation organized under the laws of the Province of Ontario, Canada. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
TariffBench provides analytics, benchmarking, and monitoring tools built on U.S. trade-remedy records, including antidumping and countervailing-duty proceedings, appellate litigation, and related public filings. The Service is provided for informational and professional-research purposes.
2. Not legal advice
TariffBench is an information tool, not a law firm, and use of the Service does not create an attorney-client relationship. Nothing in the Service constitutes legal advice, and you should not rely on it as a substitute for the judgment of qualified counsel. You are solely responsible for any decision you make using the Service.
3. Data and sources
The Service draws on public records, including the Federal Register, decisions and dockets published by CourtListener and the U.S. Court of International Trade and Court of Appeals for the Federal Circuit, and U.S. Customs and Border Protection materials. While we work to keep the data accurate and grounded in its source, we do not warrant that it is complete, current, or error-free, and the underlying records may themselves contain errors or be superseded.
4. Accounts
Some features require an account. You agree to provide accurate information, to keep your credentials secure, and to be responsible for all activity under your account. You must be at least the age of majority in your jurisdiction and authorized to accept these Terms on behalf of any organization you represent.
5. Acceptable use
You agree not to:
- resell, sublicense, or redistribute the Service or its data except as expressly permitted;
- scrape, harvest, or bulk-export data beyond the limits of your plan or the provided export features;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- use the Service to violate any law or the rights of any third party; or
- interfere with or disrupt the integrity or performance of the Service.
6. Subscriptions and fees
Certain features are offered on a paid basis. Fees, billing cycles, and plan terms will be described at the point of purchase. Unless stated otherwise, fees are non-refundable and exclusive of applicable taxes. We may change pricing on a prospective basis with notice.
7. Intellectual property
The Service, including its software, design, and compiled analytics, is owned by Futurist IP and protected by applicable law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes. The underlying public records are not owned by us; our rights attach to the compilation, structuring, and presentation of that data.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, Futurist IP will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Futurist IP from any claims, damages, and expenses arising out of your use of the Service or your breach of these Terms.
11. Termination
We may suspend or terminate access to the Service at any time if you breach these Terms or to protect the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute arising out of these Terms or the Service.
13. Changes
We may update these Terms from time to time. Material changes will be reflected by the “last updated” date above, and your continued use of the Service after changes take effect constitutes acceptance.
